What these terms cover
These terms govern the use of the website. They do not govern produce supplies: sales, purchases from growers and deliveries are governed by separate contracts, order confirmations and specifications agreed with each trading partner.
How we process personal data is described in our privacy policy.
Website information is not an offer
Descriptions of varieties, calibres and packaging, the seasonal calendar, volumes, loading dates, Incoterms rules and response times are for information only. They are not an offer within the meaning of Article 66 of the Polish Civil Code but an invitation to enter into negotiations (Article 71 of the Polish Civil Code).
Availability depends on the season: frost during blossom or hail can change volumes and calibres from one week to the next. We are bound only by a written offer from our sales team stating the price, the Incoterms 2020 rule, the product specification, the loading window and the validity period.
Quotation request form
Submitting the form is not an order and does not create a contract. By submitting it you confirm that the data is true and, if you write on behalf of a company, that you may represent it in this matter.
Do not use the form to send bank details, passwords or confidential documents. We agree on such information through another channel once we start working together.
Rights to content
The text, photographs, the Mercur mark and the website layout belong to us or are used under licence.
You may:
- browse the website;
- print pages and share them with people in your company who take part in the purchase.
Without our written consent you may not:
- change the content or publish it without stating that it comes from mercurco.com;
- use photographs from the website in sales materials, on labels or in online shops;
- sell the content or use it for other commercial purposes;
- scrape the content or use it to train artificial intelligence models.
Links to other websites
The website links to services we do not run, such as LinkedIn and WhatsApp. We are not responsible for their content or for how they process data. Read their terms and privacy policies before using them.
Security
You must not introduce malicious software to the website, overload it with automated requests or try to access its back end. You must not submit unlawful content through the form, or other people's data without their knowledge.
We work to keep the website available and free of errors but cannot guarantee it. We may take it offline temporarily, for example for maintenance.
Liability
We take care to keep the information on the website accurate and up to date, but we do not guarantee that it is complete. Base purchasing decisions on a written offer and specification, not on the website.
To the extent permitted by law, we are not liable for damage resulting from the use of the website or from interruptions in its availability. We do not exclude liability for damage caused intentionally or in any other case where the law does not allow it.
Governing law and disputes
These terms are governed by Polish law. Disputes with businesses are resolved by the common court competent for Mercur's registered office. If you are a consumer, you keep the protection given to you by the mandatory laws of your country of residence.
These terms are available in Polish and English. If the versions differ, the Polish version prevails.
Changes to these terms
We may change the website, its content and these terms. The date of the last change is shown at the top of this page. Using the website after a change means you accept the new version.
